Let’s start with the 4 different levels of the foreclosure process so you can have a basic understanding of how they work and how it relates to you going through one or you want to buy one. I will try to keep it simple.

1. The Default Stage

The beginning phase where the property owner is late in their mortgage payments and probably has received a Default Notice from their bank. This is where you start to panic and need to know your options! Prepay for Consultation time so we can help give you your options!

2. The Short Sale Stage

The middle phase where the bank may have agreed to accept less than what the homeowner owes to the bank to sell the property. You find out the bank may accept less than what you owe but you either have not put up your house for sale yet or you have a clueless agent and don't know what to do!

3. The Foreclosure Stage

The "near end" phase which is broken down usually in 2 parts although each State may be a little different. The 1st way is by Strict Foreclosure where the bank takes the deed back and asks you to leave or the 2nd way is an Auction By Sale – where the property will be auctioned right on the premises at a later specific date.

4. The “REO” or Real Estate Owned Stage

REO stands for "Real State Owned" which means the bank now owns the property.This is the "end stage" after the foreclosure judgment is entered by the Court, where the property did not sell at auction or the bank took the deed back from the owner of the property. Don't wait for this to happen!

Deficiency Judgments: Did you know that even AFTER you get a foreclosure judgment against you, your creditor can file a Motion for Deficiency Judgment against you too? A Deficiency Judgment is when your creditor can come after you for the difference the house sold at auction and the amount you may still owe your creditor! THAT MEANS that even after you lost your house through foreclosure and now have bad credit for years, your nightmare may not be over! The creditor may still be able to come after you for the difference of monies you still owe them!

For example, let's say you owed the bank $200,000 on your mortgage when you got a foreclosure judgment against you and the property sold at auction for $150,000. That bank may still be able to come after you for the $50,000 they lost at auction and they may be able to STILL COME AFTER YOU for that Deficiency through a Motion for Deficiency Judgment!
